These Terms of Service apply to purchases made through LILUART.ca.
LILUART is operated by Tetiana Ivanova, carrying on business as LILUART, in British Columbia, Canada.
By placing an order through our website, you agree to these Terms of Service. Nothing in these Terms limits any rights or remedies that cannot legally be excluded under the laws of British Columbia or other applicable consumer protection laws.
1. Products
LILUART offers apparel and other products, including products produced on a print-on-demand basis.
Product descriptions, available sizes, colours, materials and other relevant product information are provided on the applicable product page.
Because products may be manufactured or printed individually, minor variations in colour, print placement or appearance may occur. Such variations do not affect any rights a customer may have where a product is defective, damaged, materially different from its description, or where applicable law otherwise provides a remedy.
2. Prices and Currency
Unless otherwise stated, prices displayed on LILUART.ca are in Canadian dollars (CAD).
Applicable taxes, shipping charges and other charges that can reasonably be determined before purchase will be shown during checkout before the customer completes the order.
For international orders, customs duties, import taxes, brokerage fees or similar charges may apply. Where these charges cannot reasonably be determined by LILUART in advance, they are not included in the amount charged by LILUART and may be payable by the customer to the applicable authority or carrier.
3. Orders and Payment
Before completing an order, customers are responsible for reviewing the products selected, quantities, sizes, colours, shipping information, price and other order details.
Customers will have an opportunity during checkout to review and correct information before submitting the order.
Payment is due at the time the order is placed unless another payment arrangement is expressly shown at checkout.
An order is subject to successful payment authorization and acceptance by LILUART.
The order confirmation and the information presented during checkout form part of the agreement between the customer and LILUART.
4. Production and Delivery
Many LILUART products are made to order. Production time and shipping time are separate.
Available delivery information and the applicable estimated delivery date or delivery range are shown during checkout, in the order confirmation, or in the applicable Shipping Policy.
Where a delivery range is provided, the last date of that range will be treated as the expected supply date for the order unless the customer is subsequently notified of and agrees to a different date.
Delivery times may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather or other transportation disruptions.
Nothing in this section limits a customer's cancellation or refund rights under applicable consumer protection law where goods are not supplied within the legally required period.
Customers are responsible for providing a complete and accurate delivery address.
5. Shipping
Shipping charges, where applicable, are disclosed during checkout before the order is completed.
Additional shipping information is available in our Shipping Policy, which forms part of these Terms.
For international shipments, customs authorities or carriers may impose duties, taxes or brokerage charges that cannot reasonably be determined by LILUART in advance.
6. Returns, Exchanges and Refunds
Our Return and Refund Policy forms part of these Terms and explains our regular return, exchange, cancellation and refund rules.
Because many LILUART products are produced specifically after an order is placed, returns or exchanges for change of mind, incorrect size selection or other customer preference reasons may be restricted as described in our Return and Refund Policy.
These restrictions do not limit rights provided by applicable consumer protection law.
If an item arrives damaged, defective, incorrect, or materially different from the item ordered, please contact us at hello@liluart.ca as soon as reasonably possible.
7. Statutory Consumer Rights
Customers may have cancellation, refund or other rights under the British Columbia Business Practices and Consumer Protection Act and other applicable laws.
Nothing in these Terms, our Shipping Policy, or our Return and Refund Policy is intended to waive or restrict any right that cannot legally be waived or restricted.
Where applicable law gives the customer greater rights than these Terms or our store policies, the applicable law will prevail.
8. Order Changes and Cancellations
If you need to change or cancel an order, contact us as soon as possible at hello@liluart.ca.
Because print-on-demand production may begin shortly after an order is placed, we cannot guarantee that a voluntary change or cancellation can be made once production has started.
This does not affect cancellation rights that a customer may have under applicable law.
9. Intellectual Property
Unless otherwise stated, original artwork, illustrations, designs, graphics, logos, photographs and other original content created for LILUART and displayed on LILUART.ca are owned by or licensed to LILUART and are protected by applicable intellectual property laws.
Content may not be reproduced, copied, distributed, sold or used commercially without permission from LILUART, except where permitted by law.
10. Website Information
We make reasonable efforts to ensure that product descriptions, prices and other information displayed on LILUART.ca are accurate.
Occasionally, information may contain an error or omission. Where an error affects an order, we will take reasonable steps to correct it and, where required, provide the customer with an appropriate option or remedy.
11. Third-Party Services
Our online store is hosted using Shopify and may use third-party payment processors, fulfilment providers, shipping carriers and other service providers to process and fulfil orders.
Use of customer information is also governed by our Privacy Policy.
12. Limitation of Liability
To the fullest extent permitted by applicable law, LILUART will not be responsible for indirect, incidental or consequential losses arising from the use of the website or products where such liability may legally be limited.
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
13. Governing Law
These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada.
If mandatory consumer protection laws in another jurisdiction apply to a customer's purchase, nothing in these Terms is intended to remove rights provided by those laws.
14. Changes to These Terms
We may update these Terms from time to time.
The Terms that apply to an order are the Terms made available to the customer in connection with that order at the time the purchase is made, subject to applicable law.
